A restraining order is also called a protective order. It is an order a court issues to protect a person from violence, harassment, threats of physical injury, and stalking. A restraining order can be issued against a household member, family member, colleague, friend, or any person who threatens another person's safety.

This level of protection is provided by emergency protective orders (EPOs). An EPO is usually requested by a law enforcement officer responding to a domestic violence scene. This order remains valid for 7 days, and at the end of its expiration date, a judge may issue a TRO (temporary restraining order). 

A TRO provides temporary protection. They generally remain valid for no more than 25 days. These orders remain in effect until a judge holds a hearing to determine whether to issue a PRO (permanent restraining order). 

PROs provide more permanent protection. They are granted after a hearing if a judge determines the victim requires further protection. Civil harassment PROs last up to three years, while DVROs last up to five years. A victim can request an extension of permanent protection before it expires.

Some conditions in a restraining order require the restrained party to:

  • Not to contact the victim whatsoever
  • Vacate the home where they lived with the victim
  • Not to visit certain locations, such as the victim's workplace, home, or school
  • Keep a given distance from the protected party
  • Surrender all ammunition or firearms to the authorities

If a restrained party violates any of the above conditions, they may face criminal charges for violating a restraining order, which may result in jail time and fines.
